Can you resign during probation in the UAE? Labour Law rules on notice, penalties and labour bans

Many employees in the UAE assume that a probationary period offers little protection, and that leaving early is either impossible or automatically penalised. Neither is true. Federal Decree-Law No. 33 of 2021 sets out a clear framework for resigning while on probation — and understanding the rules can help you avoid unnecessary disputes, delays, or even a labour ban .

Can you resign during your probation period?

Yes, you are fully entitled to resign during probation, which under UAE law cannot exceed six months . However, you must follow the required notice period, which depends on what you plan to do after leaving :

  • Moving to another job within the UAE: You must give your current employer at least one month's (30 days) written notice .

  • Leaving the UAE: You must give 14 days' written notice .

Skipping the notice period — or leaving the country without formally notifying your employer — can trigger a one-year labour ban and make it difficult to secure a new work permit .

Do you have to pay your employer if you resign?

The employee does not typically have to pay anything directly to the former employer simply for resigning properly and giving the required notice . The obligation to compensate the original employer for recruitment-related costs falls on the new employer, not the employee .

According to Article 9(3) of the Labour Law, when an employee moves to another UAE employer during probation, the new employer must compensate the original employer for recruitment or contracting costs, unless the parties agree otherwise . This is a business-to-business arrangement — employees should not accept demands from a former employer to personally settle such costs .

What is the biggest mistake employees make?

According to legal experts, the most common and costly mistake is simply not putting the resignation in writing and not observing the notice period at all . Resigning by simply not showing up can result in compensation equal to your wages for the unserved notice period and, if you leave the country without notice, a potential one-year work ban .

There are exemptions to the labour ban — including for Golden Visa holders, family-sponsored residents, and certain skilled professionals — but you should not assume you qualify without checking .

The safe approach: resign formally in writing, respect the notice period, and keep documentation of every step .
